TERMS & CONDITIONS OF PARTICIPATION TO WELLNESS SERVICES

 1. Philosophy and Scope

Astraian L.Ρ. (hereinafter the “Company”) creates wellness experiences focused on connection with nature, personal empowerment, and holistic wellbeing through selected outdoor activities, hiking experiences, wellness retreats, hikes, and guided walks.

These Terms of Participation and Provision of Services (“Terms”) apply to every booking, participation, or use of the Company’s services, whether conducted in person or through any electronic platform.

Participation in any activity constitutes full and unconditional acceptance of these Terms, as applicable from time to time, in accordance with Greek law and applicable European consumer protection and personal data legislation.

2. Definitions

For the purposes of these Terms:

  • “Participant” means any natural person participating in any activity or session organized by the Company.
  • “Activities” means hikes, guided trail walks, retreats, workshops, and alternative wellness sessions.
  • “Alternative Therapies” means non-medical wellness services.

3. Nature and Character of the Services

3.1 The Company’s services are provided exclusively for wellness, recreational, personal development, and experiential purposes.

3.2 Any holistic or alternative services provided by the Company do not constitute medical treatment, psychotherapy, or healthcare services within the meaning of Greek law.

3.3 No information, practice, or session provided within the framework of the Activities shall substitute medical advice, diagnosis, treatment, or monitoring by a licensed healthcare professional.

3.4 The Company reserves the right, at its sole discretion, to select its collaborators, mountain guides, facilitators, or third-party service providers.

4. Participation Requirements

4.1 The Participant declares that they:

  • are over 18 years of age or participate with written consent from a legal guardian,
  • are in adequate physical and mental condition,
  • do not suffer from any condition that would render participation unsafe.

4.2 The Company reserves the right to refuse participation to any person if it reasonably considers that such participation may endanger the individual or others.

5. Participant Responsibility

5.1 Participation in the Activities is undertaken entirely at the Participant’s own risk.

5.2 The Participant is required to:

  • follow the instructions of the Company’s guides, facilitators, and collaborators,
  • use appropriate equipment and clothing,
  • disclose in advance any medical conditions or limitations.

5.3 The Participant acknowledges that outdoor activities involve inherent risks, including but not limited to:

  • injuries,
  • falls,
  • exposure to weather conditions,
  • natural obstacles,
  • unforeseen terrain conditions.

6. Limitation of Liability

6.1 The Company undertakes all reasonable and appropriate measures for the safe organization and execution of the Activities, in accordance with the principles of good faith and professional diligence.

6.2 The Participant acknowledges that outdoor and wellness activities may involve inherent and not fully foreseeable risks.

6.3 To the maximum extent permitted under Greek law, the Company shall not be liable for:

  • injuries resulting from pre-existing medical conditions or failure by the Participant to disclose relevant information,
  • loss, theft, or damage of personal belongings,
  • delays, modifications, or cancellations due to weather conditions or force majeure events,
  • acts or omissions of third-party service providers.

6.4 Any liability of the Company shall be strictly limited to cases of wilful misconduct or gross negligence, in accordance with Articles 330 and 332 of the Greek Civil Code and any other applicable provisions of law.

7. Medical Declaration and Consent

7.1 The Participant declares that they understand the nature of the Activities and participate voluntarily.

7.2 The Participant consents to the provision of basic first aid measures in case of emergency.

7.3 The Company reserves the right to contact emergency services whenever deemed necessary.

8. Bookings – Payments – Cancellations

8.1 A booking shall be considered valid only upon confirmation of payment or deposit.

8.2 The Company reserves the right to modify prices, schedules, programs, and routes.

 8.3 Cancellation Policy:

  • Cancellation up to 48 hours before the Activity: 80% refund.
  • Cancellation up to 24 hours before the Activity: 50% refund.
  • Cancellation within a shorter period: non-refundable.

8.4 The Company may cancel or modify an Activity due to:

  • weather conditions,
  • safety concerns,
  • force majeure,
  • insufficient number of participants.

In such cases, the Company may, at its discretion and in accordance with applicable law, either provide a new date or issue a refund.

 9. Participant Conduct

9.1 Participants are required to behave respectfully, responsibly, and safely at all times.

9.2 The Company reserves the right to remove any Participant without refund if they:

  • violate safety instructions,
  • endanger others,
  • display aggressive, abusive, unlawful, or inappropriate behavior.

 10. Personal Data Protection

10.1 The Company processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Greek legislation.

10.2 Personal data is used exclusively for:

  • booking management,
  • communication with Participants,
  • safety purposes,
  • compliance with legal obligations.

10.3 Participants have the right to access, rectify, erase, and restrict the processing of their personal data in accordance with the GDPR.

10.4 The Company’s Privacy Policy forms an integral part of these Terms.

 11. Photographs and Audiovisual Material

11.1 Photographs and video recordings may be taken during Activities for promotional and marketing purposes.

11.2 Participants may object to the use of their image by providing written notice to the Company prior to the Activity.

11.3 Participants are not, under any circumstances, allowed to film during the way to the destination or share any information of how , where etc.

 12. Intellectual Property

All content, materials, methods, trademarks, and texts belonging to the Company are protected by intellectual property rights and may not be reproduced or used without prior written permission.

 13. Force Majeure

The Company shall not be held liable for failure to fulfil its obligations due to force majeure events, including but not limited to natural disasters, extreme weather conditions, strikes, pandemics, or governmental restrictions.

 14. Governing Law and Jurisdiction

These Terms shall be governed by Greek law.

Any dispute arising from or relating to these Terms shall fall under the exclusive jurisdiction of the courts of Athens, Greece.

 15. Severability

Should any provision of these Terms be deemed invalid or unenforceable, such invalidity shall not affect the validity and enforceability of the remaining provisions.

 16. Amendments

The Company reserves the right to amend these Terms at any time.

Any amendments shall enter into force upon publication on the Company’s website.
